These Terms of Service ("ToS") govern access to and use of the Aiybiz platform (the "Service"), operated by Aiybiz, a company based in Paris, France. Aiybiz is a SaaS platform that provides access to artificial intelligence agents developed and operated directly by Aiybiz.
By using the Service, the User accepts these ToS without reservation. Users must be at least 18 years of age and acting on their own behalf or on behalf of a duly authorized legal entity. By registering on behalf of an entity, the User warrants they have the authority to bind that entity.
Registration requires accurate and up-to-date information. The User is solely responsible for maintaining the confidentiality of their credentials and for all activity conducted under their account. Any unauthorized access must be reported immediately to support@aiybiz.com. Aiybiz reserves the right to suspend any account where information is inaccurate or these ToS are violated.
4.1 Subscription Plans Access to the Service requires a paid subscription. Available plans, features, and pricing are described on the website's pricing page and are subject to change.
4.2 Billing Period and Auto-Renewal Subscriptions are available on a monthly or annual basis, at the User's election, and renew automatically at the end of each period unless cancelled before the renewal date in accordance with Section 10.
4.3 Credits Each subscription plan includes a monthly credit allowance for use of the AI agents. Unused credits expire at the end of each monthly period and are neither rolled over nor refunded. Additional credits may be purchased separately at the rates in effect at the time of purchase.
4.4 Payment Payments are processed by Stripe. The User authorizes Aiybiz to automatically charge the payment method on file at each renewal date. In the event of a payment failure, Aiybiz reserves the right to suspend access to the Service after notification.
4.5 Price Changes Aiybiz may modify its pricing with thirty (30) days' advance notice by email. Continued use of the Service after the effective date constitutes acceptance of the new pricing.
4.6 Refunds All fees paid are non-refundable except as required by applicable law or as otherwise determined by Aiybiz at its sole discretion.
The User agrees to use the Service in compliance with applicable law and these ToS. The following are expressly prohibited:
Aiybiz reserves the right to suspend or terminate any account found in violation of these rules.
6.1 Aiybiz Property The platform, AI agents, interfaces, databases, software, and all content made available by Aiybiz are and remain the exclusive property of Aiybiz or its licensors. Nothing in these ToS grants the User any ownership rights over these elements.
6.2 License to Use Aiybiz grants the User, for the duration of their active subscription, a personal, non-exclusive, non-transferable, revocable license to access and use the Service for internal business purposes.
6.3 Generated Content (Outputs) Outputs produced by the AI agents at the User's request are assigned to the User for personal and commercial use, subject to full payment of the applicable subscription fees and compliance with these ToS. Aiybiz reserves the right to use aggregated and anonymized usage data for the purpose of improving the Service.
6.4 User-Submitted Content The User retains ownership of data and content submitted to the Service. The User grants Aiybiz a limited license to process such content solely for the purpose of providing the Service.
Aiybiz endeavors to make the Service available 24/7 but does not guarantee uninterrupted availability. Planned maintenance and unplanned incidents may cause temporary interruptions. Aiybiz will communicate as promptly as possible in the event of a significant outage.
8.1 The AI agents provided by Aiybiz are assistance tools. The User remains solely responsible for any decisions made based on the outputs produced.
8.2 Aiybiz's liability is limited to direct and proven damages, capped at the amounts actually paid by the User in the twelve (12) months preceding the event giving rise to the claim.
8.3 Aiybiz excludes all liability for indirect damages, loss of data, loss of revenue, or loss of profits.
8.4 These limitations apply to the fullest extent permitted by applicable law.
The processing of personal data is governed by Aiybiz's Privacy Policy, available on the website, and complies with the GDPR.
10.1 Termination by User The User may cancel their subscription at any time from their account settings. Cancellation takes effect at the end of the current billing period; no pro-rata refund is provided.
10.2 Termination by Aiybiz Aiybiz may terminate access to the Service immediately in the event of a breach of these ToS, or for any other reason with thirty (30) days' notice.
10.3 Effect of Termination Upon termination, access to the Service is deactivated and any unused credits are cancelled without compensation.
Aiybiz may update these ToS at any time. For material changes, Aiybiz will provide thirty (30) days' advance notice by email. Continued use of the Service after that period constitutes acceptance of the updated ToS. If the User disagrees, they may cancel their subscription within that period.
These ToS are governed by French law. In the event of a dispute, and following an attempt at amicable resolution, exclusive jurisdiction is granted to the Courts of Paris, notwithstanding multiple defendants or third-party appeals.
